Nursing Agencies

  • Professional Indemnity: $1 million – $20 million (Excess Nil, subject to terms and conditions)
  • Public Liability: $10 million or $20 million (Excess $500)

Individual Nurses

  • Professional Indemnity: $1 million – $20 million (Excess Nil)
  • Public Liability: $20 million (Excess $500)

When considering Professional Indemnity and Public Liability cover in nursing, it’s important to understand how policy limits apply.

Agency policies are designed to cover the entity and its employees, where the policy limit is shared for the entity, meaning multiple claims draw from the same overall cover.

Individually arranged cover is structured differently. The policy limit is not shared, it is allocated solely to the individual insured, protecting your practice without being impacted by claims made against the agency or other staff.

What The Policy Responds To

Professional Indemnity and Public Liability combine to provide protection across clinical services and business activities.

This includes claims arising from the provision of Professional Services, including:

  • Medication or treatment errors
  • Failure to monitor or escalate patient care
  • Allegations of negligence

  • Injury occurring while providing care

  • Breach of duty (including duty of confidentiality)

Defence costs, investigation expenses, and court attendance costs are built into the policy structure.

Additional Policy Features

Policies arranged through MGA Insurance Group include a range of extensions and protections designed for healthcare environments:

  • Continuous cover clause
  • Inquiry costs cover up to $200,000
  • Vicarious liability for subcontractors and consultants
  • Good Samaritan cover for emergency first aid rendered in public
  • Worldwide territorial limits

Run-off cover of up to 7 years is also available for both agencies and individuals (subject to terms), providing ongoing protection after ceasing operations or practice.

Midwifery activities are excluded under standard cover; however, extensions can be arranged for agencies where required. A limited write-back can also provide cover for certain midwifery services, excluding the actual birthing process, subject to underwriting.

Examples of possible claims

Example 1

A nurse is placed on temporary assignment with a third party. During the placement, a patient under the nurse’s care dies. The patient’s family sues claiming mental injury, depressive illness, loss of earning capacity and ability and a raft of personal injuries.

Example 2

An agency nurse administers morphine to a patient who suffers respiratory failure resulting in hypoxic brain injury. The patient sues for ongoing medical expenses and mental injury.

Example 3

Whilst providing post-operative care for a patient, it is alleged that the agency nurse did not contact the appropriate surgeon after noticing the patient’s responsiveness was getting worse. A claim is made against the nurse for negligence.
